Article 1 – Nature of services and scope
The platform enables consultations, access to teaching, software subscriptions and the sale of products.
The site is accessible at www.icerns.com from any device.
The site is available 24/7 except for maintenance; the Company is bound only by a best-efforts obligation.
Article 2 – Access to services
2.2 Access conditions: access requires legal capacity under French and European law. Part of the site is accessible without registration. The Client must provide an accurate name, e-mail and phone number.
2.3 Consultations: consultations are provided by independent numerologists referenced by the Company, which acts as an intermediary. Practitioners must comply with the Ethical Charter. Numerology is not a substitute for any activity falling within the field of public health.
Payment: immediate payment by bank card through the Payzen processor, or payment in three (3) installments; in the latter case the appointment must be set about 2.5 months after the transaction so that all installments are collected.
Cancellation initiated by the Practitioner: the Practitioner offers a new date or a full refund, at the Client's choice, free of charge.
Article 2.3 e) – Cancellation initiated by the Client
A cancellation requested more than fifteen (15) calendar days before the scheduled appointment date entitles the Client to a refund, less a flat amount of five (5) euros (bank and administrative fees).
A cancellation requested between fifteen (15) and eight (8) calendar days entitles the Client to a refund, less a flat amount of fifty (50) euros (preparation costs).
No refund is made for any cancellation made 7 calendar days or less before the appointment.
The Client alone bears the consequences of failing to attend an appointment set with a Practitioner; in this case no refund will be made (except in cases of force majeure).
Article 2.5 – Sale of products and right of withdrawal
Pursuant to article L. 221-18 of the French Consumer Code, the Client has a right of withdrawal of fourteen (14) calendar days from receipt of the product. This right applies to catalog products.
For customized online products, the Client has accompanied the purchase with an express waiver of the right of withdrawal.
The product must be returned new, unused and in its original packaging to: 18 rue Jean Edgard Glady, 33140 Villenave d'Ornon. Return shipping costs are borne by the Client. The refund is made within 14 days of receipt and verification of the product's integrity.
Conformity and hidden defects: application of articles L. 217-4 to L. 217-5 of the Consumer Code and article 1641 of the Civil Code; in case of non-conformity, exchange or refund at the Client's choice.
Article 3 – Content and reviews
The Client must have received the relevant service before being able to post a review.
Illegal, defamatory, political or religious content is prohibited.
The Client assigns their rights and grants the Company an unlimited right of reproduction, worldwide, for marketing, posting on social media and republication purposes.
Article 4 – Limitation of liability
4.1 a) The Company is not liable for network failures, hacking, malware or user error; it is exempt from indirect damages, data loss and business interruption, as well as failures of the host, the ISP or the Client's devices.
4.1 b) Practitioner services: the Company bears no liability for the quality of consultations, the advice given, the decisions made by the Client, or the Practitioner's delays or cancellations.
4.1 c) Sale of products: legal warranty of conformity under the Consumer Code; stains, abnormal wear, and damage related to moisture or heat are excluded; hidden defects covered by article 1641 of the Civil Code.
4.1 d) Force majeure: strikes, natural disasters, pandemics, etc.
Article 5 – Account closure
The Company may close an account in case of breach of the terms (false identity, illegal use, repeatedly non-compliant content).
The Client may close their account at any time. Closure ends access to the services and stored data.
Article 6 – Data protection
Data processing complies with the GDPR (EU regulation 2016/679) and French law no. 78-17. The full policy is set out in the “Privacy Policy” document.
Article 7 – Intellectual property
The Company owns all site content (text, graphics, design).
Registered trademarks: ICERNS (verbal mark, FR no. 21 4 736 653; international no. 1 625 973) and Numérologie Stratégique (semi-figurative mark, FR no. 20 4 668 783).
Database rights are protected and educational content is protected by copyright and unfair-competition law.
Article 8 – Miscellaneous
8.3 Mediation (Order no. 2015-1033): after a prior complaint to the Company, the Client may use a consumer mediator free of charge, namely: Société de la Médiation Professionnelle – Médiateurs Associés, 24, rue Albert de Mun, 33000 Bordeaux, saisine@www.mediateur-consommation-smp.fr; or Centre de la médiation de la consommation des Consultations de justice (CM2C), 14, rue Saint Jean, 75017 Paris, https://www.cm2c.net/.
8.4 Governing law and jurisdiction: French law applies; the competent court is that of the defendant's domicile.
